PRIVACY POLICY

This privacy policy (the “Policy”) is intended to inform you of the types of information Abilitare, Inc. (“we” or “us” or “Abilitare”) collects, as well as our policies and practices regarding the collection, use, and disclosure of that information through the web pages at https://www.abilitare.com/ or any other sites owned and controlled by us (the “Site”) or through its hardware and software devices, including the Abili Mouse™ (the “ Devices”).  

Please read this Policy carefully, because by using our Site or any Device, you are acknowledging that you understand and agree to the terms of this Policy, and consent to the types of information and the manner in which we may collect, use and disclose such information. If you do not agree to the terms of this Policy, please do not use the Site or Device(s).

We reserve the right to change the provisions of this Policy at any time. We will alert you that changes have been made by indicating on the Policy the date it was updated. We encourage you to review this Policy from time to time to make sure that you understand how any information you provide will be used.  Each time you access the Site or use one of our Devices, the most recent version of the Policy will apply. Your continued use of the Offering following the posting of changes to these terms will mean you accept those changes.

  • Personal Information You Provide to Us 

    We only have access to and collect personal information that you voluntarily give us by filling out our online forms, email or other direct contact from you, such as: your name, mailing address, telephone number, email address, and email preferences (collectively, “Personal Information”).  

    You do not need to provide us any Personal Information to browse or use our Site, but if you do provide any such Personal Information on or through the Site, this Privacy Policy will govern our collection and use of the Personal Information.   

    Information Collected by Automated Means 

    Whenever you use the Site or a Device, we and/or our service providers may use a variety of technologies that automatically collect information about how the Site or Device is accessed and used (“Usage Information”). Usage Information may include, in part, browser type, operating system, the page viewed, the time, how many users visited the Site, the website you visited immediately before the Site and how often or many hours you used the Device. This statistical data provides us with information about the use of the Site and our Devices. Usage Information helps us to keep the Site user friendly and to provide visitors with readily accessible and helpful information. Usage Information may also help us use and improve our Devices. We may also use your Usage Information to troubleshoot issues with access or use of our Site or Devices. Usage Information is generally non-identifying, but if we associate it with you as a specific and identifiable person, we treat it as Personal Information. 

    We believe that such technology usage is fair, lawful, and proportional to the legitimate interest and needs of our business, and that our methodology fairly addresses each user’s legitimate rights and expectations in view of the context and purpose for the collection and use of the information collected.  

    Identifiers 

    In the course of collecting Usage Information we may also collect your IP address, MAC Address or other unique identifier (each a “Identifier”) for the computer, mobile device, internet provider or other technology you use to access the Site or with which you use a Device. An Identifier is a number that is automatically assigned to your computer or other technology when you access a web site or its servers. Our computers identify your computer or other technology by its Identifier. When you visit the Site or use a Device, we may view your Identifier. We use this information to identify repeat visitors to our Site and repeated usage of the Device. We also may use this information to enhance the Site or Device and troubleshoot issues with access or use of our Site or Devices. We may associate your Identifier with your Personal Information.

    The technologies used on the Site, including Identifiers, to collect Usage Information may include, without limitation:

    Cookies – Cookies are data files placed on a Device when it is used to visit the Site. We may use cookies to collect and store certain information about you. We may use both session cookies (which expire once you close your web browser) and persistent cookies (which stay on your computer until you delete them).

    Web Beacons – We may also include web beacons (also known as web bugs, Internet tags, pixel tags, tracking pixels and clear GIFs) with the content and information that we deliver to you, which we will use to collect information regarding your interaction with our Site. A web beacon is a transparent graphic image placed on a web page or in an email, which indicates that a page or email has been viewed or that an email has been forwarded. In addition, a web beacon allows us to obtain information such as the IP address of the computer that downloaded the page on which the beacon appears, the URL of the page on which the beacon appears, the time the page containing the beacon was viewed, the type of browser used to view the page, and the information in cookies set by us. A web beacon may also tell your browser to get content from another server.

    Cookies and web beacons (together, “Site Cookies”) may enable us to track and target the interests of our users to enhance the experience on our Site, track user actions/behavior on our Site and track the effectiveness of our Site. 

    If you want to prevent the use of certain cookies, you do have the ability to opt out.  Please refer to the “Your Access to and Control Over Your Information” Section below for details on how to opt out. 

    Analytics

  • How Do We Use Your Information?
  • We will use your information to respond to you regarding the reason you contacted us. We will also use your information as follows:

    • To Support Our Products and Services - This could include fulfilling your requests for products or services. It could also include processing purchases, warranty claims or return transactions. We may contact you regarding updates to our Devices, including software updates, corrections or security patches. 
    • To Improve Our Products and Services - We may use your information to enhance our Site and Devices to serve you better. 
    • To Respond to Your Requests, Chats or Questions - This may include responding to your customer feedback, setting up product demonstrations and providing customer support.
    • For Security Purposes - This could include protecting our company and our other customers. It may also include protecting the Site or Devices.
    • For Marketing Purposes. We may provide you with information about new products and special offers. We may use your information to serve you ads about products and offers. We may tell you about new features or updates. These might be third-party offers or products we think you might find interesting. You will have the ability to opt out of any such marketing communications.  If you sign up to receive our newsletters, we will use your information to send these newsletters to you. 
    • Law or regulatory obligations - Certain laws and regulations require us to maintain and disclose collected information.  
    • Customer Service – Unless you ask us not to, we may contact you via email in the future to tell you about changes to our Service, changes to this Policy and/or new services being offered by us.

    We may send out e-mails with news, products, offers, surveys or promotions. You may also receive notification e-mails from us that inform you of actions that have been performed on the Site or relating to the Devices. If you do not want to receive e-mail from us, please follow the instructions contained in the unwanted e-mail message. However, please note that in all cases you will continue to receive all system e-mails (e.g. those regarding forgotten user passwords) and legal notices (e.g. updates to our policies) from us.  If at any time you wish that we cease communication with you, please notify us using the contact information provided below in the “Contact Us” section or as indicated in the electronic communication.

    By agreeing to our Terms and this Policy, you are consenting to our use of your Personal Information for the purposes listed.  We may also have the right to collect and use your Personal Information in the above-described manner for the performance of a contract, for entering into a contract with you, or to comply with a legal obligation.

  • Do We Share Your Information?
  • We will not trade, rent, or sell your Personal Information to third parties unless you ask or authorize us to do so.

    Unless you ask or provide your consent to do so, we will not share your Personal Information with any third party outside of our organization, except as necessary, with our service providers and subcontractors in order to fulfill your orders and requests (e.g. to deliver products or software), or troubleshoot issues you may have with our Site or Devices your account or as otherwise necessary in connection with the provision and use of the Devices. Only employees, service providers and subcontractors who need the Personal Information to perform a specific job (for example, billing, customer service, delivery of equipment or software) are granted access to Personal Information. The computers/servers in which we store Personal Information are kept in a secure environment.

    We will disclose Personal Information when we believe in good faith that such disclosures (a) are required by law, including, for example, to comply with a court order or subpoena, or (b) will help to: enforce our policies; protect your safety or security, including the safety and security of property that belongs to you; and/or protect the safety and security of our Site or Devices, us, our employees, our service providers, our subcontractors, other third parties, or equipment that belongs to us, our service providers, or our subcontractors. Disclosures in this limited scenario would be made to a court of law, law enforcement, or other public or government authority. 

    If we become involved in a merger, acquisition, or any form of sale of some or all of our assets, your information may be included in the assets sold or transferred to the acquirer, and may be initially disclosed to the potential acquirer as a part of due diligence.  You hereby agree that we may transfer or assign the information we have collected from you in connection with any such event.  Any information that you provide after the merger, acquisition, or sale may be subject to a new privacy policy adopted by the successor entity. In the event of a bankruptcy, insolvency, reorganization, receivership or assignment for the benefit of creditors, we may not be able to control how your Personal Information is treated, transferred or used.  

    Your Access to and Control Over Your Information

    We offer you choices regarding the collection, use, and sharing of your Personal Information. Our Site does not currently respond to browser-based do-not-track signals. You can choose to have your computer warn you each time a cookie is being set, or you can choose to turn off all cookies. You do this through your browser settings. Each browser is different, so look at your browser's Help menu to learn the proper way to modify your browser’s cookies setting.

    If you disable cookies, some features may be disabled that make your experience with our Site more efficient and some of our services may not function properly.

    You may do the following at any time by contacting us via the email address or phone number provided on our Site:

    • See what data we have about you; if any.
    • Change or correct any data we have about you.
    • Have us delete any data we have about you.

    We do not charge for these services. Your request will be processed within 30 days of the date on which we receive it.

    If you do not want your information to be shared with our employees, service providers and subcontractors, upon your request, we will not share your information. However, your ability to access and use our Site or the Devices, request information or demonstrations, obtain customer support or obtain products and services, may be unavailable, limited or interrupted.

  • What Steps Do We Take To Protect Your Information?
  • We take measures designed to protect your Personal Information in an effort to prevent loss, misuse, and unauthorized access, disclosure, alteration, and destruction. We provide physical, electronic, and procedural safeguards to protect Personal Information we process and maintain. Please be aware, however, that despite our efforts, no security measures are perfect or impenetrable and no method of data transmission can be guaranteed against any interception or other types of misuse. To protect the confidentiality of Personal Information maintained in your account, you must keep your password confidential and not disclose it to any other person. You are responsible for all uses of the Devices any person using your password. Please advise us immediately if you believe your password has been misused.

  • Does This Policy Apply to Other Websites Linked To Or From the Site?
  • The Site may contain links to other websites. Any Personal Information you provide on linked pages or sites is provided directly to that third party and is subject to that third party’s privacy policy. This Policy does not apply to such linked sites, and we are not responsible for the content or privacy and security practices and policies of these websites or any other sites that are linked to or from the Site. We encourage you to learn about their privacy and security practices and policies before providing them with Personal Information.

  • Does this Policy Apply to Abilitare’s social media pages?

  • We may have pages or other presence on various social networking sites or services, such as Facebook, Twitter and the like.  We may use such pages to communicate with you relating to the Devices or your use of the Devices, including customer support questions. Any information you post or provide through such sites and services will be subject to the policies of those sites and services. 


  • Do We Collect Information From Children Under the Age of 13?
  • Abilitare does not knowingly collect or use any Personal Information from such children. If we become aware that we have unknowingly collected Personal Information from a child under the age of 13, we will make commercially reasonable efforts to delete such Personal Information from our database.

  • What if I am resident of California? 

  • California requires operators of websites or similar services to make certain disclosures to users who reside in California regarding their rights, specifically:


    Shine the Light


    For clarity, we will not trade, rent, share or sell your Personal Information to third parties unless you ask or authorize us to do so. However, if we disclose Personal Information that is primarily used for personal, family, or household purposes of a California user to a third party for said third party’s direct marketing purposes, we will identify such third party along with the type of personal data disclosed, upon your request. 


    For further clarification, please refer to the “Contact Us” section below. Under California law, businesses are only required to respond to a user’s request once during any calendar year.


    Do-Not-Track


    Some browsers give individuals the ability to communicate that they wish not to be tracked while browsing on the Internet. California law requires that we disclose to users how we treat do-not-track requests. The Internet industry has not yet agreed on a definition of what “Do Not Track” means, how compliance with “Do Not Track” would be measured or evaluated, or a common approach to responding to a “Do Not Track” signal. We have not yet developed features that would recognize or respond to browser initiated Do Not Track signals in response to California law. In the meantime, there are technical means to prevent some of the tracking. See Section “Your Access to and Control Over Your Information”.


  • What if I am an EU/EEA Resident? 

  • The EU General Data Protection Regulation (GDPR) grants individuals who are in the European Union and European Economic Area (EU/EEA) the following rights, with some limitations. You may contact us, at the address provided in the “Contact us” section below, to exercise any of those rights and we will respond with the requested action or information, or will let you know why that right does not apply to you.


    Right Not to Provide Consent or to Withdraw Consent

    We may seek to rely on your consent in order to process certain personal data. Where we do so, you have the right not to provide your consent, and the right to withdraw your consent at any time. If you withdraw your consent, this will not affect the lawfulness of the processing conducted based on consent before its withdrawal.


    Right of Access

    You have the right to obtain confirmation as to whether or not we collect or process personal data concerning you and, if this is the case, you have the right to request a copy of such personal data in digital format.


    Right of Rectification

    You have the right to require that we correct any inaccurate personal data concerning you, and that we complete incomplete personal data.


    Right of Erasure

    In certain circumstances, you have the right to request that we erase personal data concerning you; for example, if it is no longer necessary for the purposes for which it was originally collected.


    Right to Restrict Processing

    In certain circumstances, you have the right to request that we restrict the processing of the personal data that we have collected about you; for example, where you believe that the personal data that hold about you is not accurate or lawfully held.


    Right to Data Portability

    In certain circumstances, you have the right to receive the personal data concerning you that you have provided us in a structured, commonly used, machine readable format, and the right to obtain that we transmit the data to another entity where technically feasible.


    Right to Object to the Processing

    In certain circumstances, you have the right to request that we stop processing your personal data.


    Right to Object to the Processing for Direct Marketing Purposes

    You have the right to request that we stop sending you marketing communications.


    Right Not to be Subject to Decisions Based Solely on Automated Processing that Produce Legal Effects

    In certain circumstances, you have the right no to be subject to a decision based solely on automated processing – including profiling – that produces legal effects or similarly affects you.


    Right to Complain to a Supervisory Authority

    You have the right to lodge a complaint with a supervisory authority if you believe that our processing of personal data relating to you infringes the GDPR.


  • Miscellaneous
  • This Policy and the privacy practices of Abilitare will be subject exclusively to the laws of the State of Florida in the United States. Abilitare makes no representation that this Policy and our practices comply with the laws of any other country or jurisdiction. Users of the Site or Devices who reside outside the United States do so on their own initiative and are responsible for compliance with local laws, if and to the extent local laws are applicable. If you reside outside of the United States, by using the Site or Devices, you consent to the transfer, processing, and use of your information outside of your country.
